Registration Trips 2017


General Terms and Conditions (GTC):

International exchange trips with JIK  (Status: 01.07.2016)

1. Registration

The registration is done online, over the website of the JIK, by the participant(s) for the respective trip. In the case of adults who do not pay the travel costs themselves, the written consent of the cost bearer is required. The General Terms and Conditions of the JIK, as set out herein, are herewith acknowledged, upon the legally binding registration for the trip. JIK shall acknowledge receipt of the booking and the conclusion of the contract by electronic means. The first instalment shall be due within 14 days, pursuant to the confirmation of the reservation.

Insofar as number of participants is exceeded, due to the fact that several reservations take place in quick succession, such that it was not possible to determine how many places were still free at the time of the registration, those who registered after the maximum number was reached, will be placed on a waiting list, in the order of their registration and shall be promptly informed about it by e-mail.

Insofar as you are on the waiting list, the contract shall only come into effect, if the JIK informs you via email that you are now on the participants list.

2. 14-day right of revocation

The 14-day right of revocation begins with the conclusion of the contract through the online booking. Thereafter, a cancellation of the trip is only possible pursuant to the terms and conditions, under (3.1.) and (4.).

3. Taking out of the travel cancellation and foreign health insurance

A travel cancellation and a foreign health insurance, which are already included in the price, will be taken out for all participants, no later than 7 weeks prior to departure. Insofar as someone needs medical assistance during the trip, the costs are covered by the foreign health insurance. In the case of a serious illness (medical certificate), a premature return flight is effected at the expense of the travel cancellation insurance (see above).

 3.1. Occurrence of an insured event

(after the taking out of the travel cancellation insurance)

The insured event is usually given if, as a result of the occurrence of one of the following important reasons, in the case of the policyholder / insured or a person at risk, pursuant to the conclusion of the contract or respectively pursuant to the booking of the trip, either the incapacity to travel of the policy holder / insured, has to be expected, according to general life experience or insofar as it can not be reasonably assumed that he/she can embark on the trip or complete it as scheduled: Death, severe accidental injury, unexpected serious illness, immunodeficiency, pregnancy; damage to the property of the policyholder / insured as a result of fire, elementary event or deliberate criminal offence of a third party, insofar as the damage is substantial or insofar as the presence of the policyholder / insured is necessary for the purpose of the damage assessment.

Individuals at risk are in principle in addition to the policyholder / insured, his / her spouse or civil partner, their children, parents, siblings, grandparents, grandchildren, parents-in-law, and children-in-law.

3.2. Insurance exclusion

The insurer is generally not liable for the dangers of war, civil war or war-like events, in the cases of strike, lock-out, unrest, terrorist or political violence, irrespective of the number of persons involved.

The insurer is exempt from the obligation to provide benefits, insofar as the policyholder / insured or individuals at risk, deliberately induced the insured event.

4. Travel cancellation due to uninsured reasons or prior

to the taking out of the insurance

In the case of travel cancellation for uninsured reasons, at the latest 8 weeks, prior to the trip, or prior to the taking out of the travel cancellation insurance, travel costs will only be refunded, insofar as a substitute (e.g. from a waiting list) is accepted by the JIK. Insofar as this results in additional costs for the room allocation, a flat rate additional cost, in the amount of 15 € per night, will be charged.

In the case of late cancellations, additional costs may arise among others, for new travel insurance policies, which have to be taken out, name changes in the case of flights, etc. In both cases, only the residual amount remaining after deduction of all additional costs can be refunded.

5. Method of payment

5.1.

Within 14 days of receipt of the booking confirmation, an advance payment of about 40% of the travel price shall be due; the rest payment shall be due 10 weeks before departure. Decisive is the receipt of the payment on the specified account of the JIK. Exceptions are possible by prior arrangement with the JIK, only in very special individual cases.

5.2.

Insofar as the participants or respectively cost bearers as contract partners, fail to remit the advance payment and / or rest payment in accordance with the agreed payment dates, the JIK shall be entitled after a one-time remainder with a set deadline, to withdraw from the contract and to charge the participants or respectively contractor partners the cancellation fee costs, pursuant to (4.)

6. Withdrawal and termination by the JIK

The JIK can in the following cases prior to the start of the trip, fully withdraw from the contract (6.1.) or during the preparation of the trip (see below under 10.1.-3.), as well as after the start of the trip, cancel the travel contract with individual participants (6.2.):

6.1.

In the case of the failure to reach a specified minimum number of participants (see program information about each trip) up to at least 30 days prior to the start of the trip, insofar it has been indicated in the trip description for the relevant trip that a minimum number of participants is required. The JIK may also withdraw from the contract, insofar as the requested grants for a trip are not approved. In any case, the JIK shall be obliged to promptly notify the participants or respectively the custodian, upon the occurrence of the conditions for the non-fulfillment of the trip and to forward to them the declaration of withdrawal. The paid travel price shall accordingly be refunded.

6.2.

The JIK expects the participants to respect the customs, traditions and laws of the respective host country. Insofar as participants violate these or conduct themselves, in violation of the contract, the tour head may exclude them from the further trip, in the event of repetition after prior warning. The same shall apply insofar as the participants unreasonable impair the cooperation in the group, in spite of reminders and a set deadline fail to meet their payment obligations or do not comply with the agreed contract terms and conditions. In the case of gross violations (e.g. criminal offences such as deliberate bodily injury, theft, drug consumption, deliberate damage to property or violations of the rules of conduct pursuant to 10.3.), participants may also be immediately excluded from the trip. Any costs thereby incurred shall be borne by these participants. Insofar as one of these cases occurs, these participants shall be sent home at their own expense (with a suitable means of transport depending on the destination). Additional costs may be incurred, insofar as the concerned participant is not picked up by a custodian or person who is entitled to custody and an accompanying person of the JIK must supervise the return trip. Insofar as the JIK terminates the contract due to one of the reasons mentioned, it reserves the right to the travel price.

7. Cancellation of the contract due to extraordinary circumstances

Insofar as the trip is endangered as a result of force majeure, unforeseeable at the time of the conclusion of the contract, the participant or respectively cost bearer, as well as the JIK, may terminate the contract. Insofar as the contract is terminated by the JIK, the JIK can demand a compensation to be calculated according to § 638 paragraph 3 of the German Civil Code (BGB), for the trip services already provisioned, or yet to be provisioned for the completion of the trip. In addition, the JIK is obliged to take the necessary measures, particularly if the contract covers the transport back, to return the concerned participant. The parties shall each bear half of the additional costs for the return transport. Moreover, the additional costs will be borne by the concerned participant.

8. Duty to cooperate and exclusion of claims

Insofar as individual program points, especially in the case of trips to the Middle East, can not be carried out due to force majeure, the participants have no claim for reimbursement.

Reasonable complaints must be promptly communicated to the tour head at the city of the service, so that he/she is in a position to remedy the situation. Insofar as a participant culpably fails to notify a defect, a claim for a reduction shall not be applicable. Moreover, the stated claims must be asserted with the JIK in writing, within one month after the scheduled return date, pursuant to the contract. Decisive for the compliance with this deadline, is the receipt of this letter by the Executive Board of the JIK.

9. Changes in performance and price increases

All information on the services, program, dates, departure times, prices and travel conditions, correspond to the status, at the time of the compilation of the program, as well as the registration. Changes to the services and prices are expressly reserved. In the case of trips in countries with a different currency (Israel / Palestine / Jordan / Turkey, etc.), price fluctuations can lead to an increase in the travel price, however only by a maximum of 10%. Any further reaching price increases without changes to the program shall be borne by the JIK.

10. Participation requirements

10.1. Personal details of the participants

The JIK assumes that the participants are not only healthy, but are also physically as well as mentally resilient, as far as the program and cooperation within the trip group requires.

All individual particularities (regarding food or health, e.g. allergies), or other personal information (also swimmer / non-swimmer), have to be truthfully specified in the registration. Incorrect or incomplete statements that lead to complications or stress during the trip may lead to the exclusion from the trip and regress claims on the part of the JIK.

10.2. Cooperation before the trip

The JIK expects the participants to intensively independently and impartially concern themselves with the culture, history, religion and current political developments in the host country / host countries, before the trip. For the purpose of the trip preparation, there are several mandatory meetings for all participants, especially in the case of trips to the Middle East. The concrete program is hereby worked out together with the group. In addition, all the participants receive important information about youth groups on site, the interlocutors, the political situation, the different religions, the security situation, the rules of conduct, pocket money and luggage.

Between 3 and 6 meetings take pace per trip after the composition of the group is fixed, usually in the city, in which the majority of the participants live.

Since these meetings are very timely announced, the presence of all the participants is also expected. Repeated absence due to illness (only with medical attest) can endanger participation in the trip.

All important information between the meetings will be sent by e-mail. The participants are obligated to promptly reply to the e-mails and to observe the information.

Insofar as it becomes clear that one of these prerequisites is not clearly applicable to a participant, or insofar as the cooperation of the group is unreasonably impaired by the concerned participant, the right to participate will cease to exist. The decision in this regard, is made exclusively by the tour head.

In the case of serious breaches of these participation prerequisites, the concerned shall also bear any additional costs that may be incurred.

10.3. Code of conduct during the trip (especially in the Near and Middle East)

  1. Israel-Palestine is a crisis area! Therefore, one has to refrain from all forms of provocative conduct towards locals and particularly towards soldiers. The instructions of the tour head must be followed under all circumstances.
  2. Other that on the beach, the participants should wear adequate clothing during the entire trip, which is not obnoxious for believing Jews, Christians and Muslims (in the case of women: chest, shoulders, legs and belly should be covered!). We live among others in Christian institutions, visit churches and particularly Muslim Quarters!
  3. Assumed is the willingness to imperatively comply with agreements and appointments (especially the departure in the morning) and to participate in all fixed program points!
  4. The unity of the group must be preserved, never distance yourself from the group unexcused! All participants are informed about the meeting points / times and must stick to them. Only move in groups of at least 4 participants (with cellular phone!)!
  5. In the case of the loss of identity documents, money, valuables, etc. neither the JIK nor the insurance is liable for replacement.
  6. The house rules in the accommodation must be observed. Respect for fellow human beings (Christian / Muslim institutions!) is self-evident.
  7. In the case of alcohol or drug abuse, as well as in the case of the serious violation of the rules of conduct 1-6, participants will be immediately sent home, at their own expense or respectively at the expense of the cost bearer!

11. Use of photo and video recordings

The participants agree that photos / videos can be taken of them on the trip and that they can be published on the website of the JIK.

Of course, this permission can also be revoked, in the individual case, on the trip.

Otherwise, all photos / videos of these trips are exclusively intended for private purposes and may only be exchanged within the group of participants.

It is expressly forbidden to publish photos / videos on YouTube, Facebook or other social networks, or make them accessible to third parties, without the explicit permission of the concerned depicted person.

Infringement is punishable due to the right to one's own image.

12. Ineffectiveness of individual provisions and place of jurisdiction

The ineffectiveness of individual provisions of the travel contract and of the travel terms and conditions, shall not result in the ineffectiveness of the entire contract or respectively of the entire travel terms and conditions. Only agreements made in writing are effective. Any warranty claims remain unaffected as long as the amended services are subject to defects.

The place of jurisdiction and place of performance is the registered office of the association JugendInterKult e.V.
